42vip shall not be liable for: (a) any indirect, consequential, special, incidental, or punitive damages; (b) loss of profits, revenue, data, or business opportunity; (c) losses arising from your failure to maintain account security; (d) losses arising from network outages, device failures, or third-party service disruptions; (e) errors in odds or game results caused by data feed providers; or (f) losses resulting from changes to applicable law or regulatory requirements.
Nothing in these Terms excludes or limits 42vip's liability for fraud, for death or personal injury caused by its negligence, or for any other liability that cannot be excluded or limited under applicable law.
You may close your 42vip account at any time by contacting the support team via live chat. Any remaining balance in your wallet will be processed as a final withdrawal to your registered GCash or Maya account, subject to completion of KYC verification and satisfaction of any applicable bonus wagering requirements.
42vip reserves the right to suspend, restrict, or permanently close your account at any time, with or without prior notice, in the following circumstances: violation of these Terms; suspected fraudulent activity or money laundering; receipt of a direction from PAGCOR or competent legal authority; or where continued provision of services to you would expose 42vip to legal, regulatory, or reputational risk.
Upon termination of your account by 42vip for breach of these Terms, any wallet balance may be withheld pending investigation. Where the investigation confirms material breach, 42vip reserves the right to forfeit some or all of the balance in accordance with applicable regulations.
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
In the event of a dispute between you and 42vip, you are encouraged to first contact the 42vip support team, which will endeavour to resolve the matter promptly and fairly. If the dispute cannot be resolved through direct engagement with the support team, it shall be referred to the appropriate dispute resolution mechanism established by PAGCOR for licensed online gaming operators. The courts of the Republic of the Philippines shall have exclusive jurisdiction over any disputes that proceed to formal legal proceedings.
Nothing in this clause prevents you from making a complaint directly to PAGCOR in your capacity as a player on a PAGCOR-regulated platform.
